Independent Investigations
One of the critical initial decisions in any employment-related investigation is who will actually conduct the investigation. Often times, internal human resources personnel are well suited to conduct investigations. Other times, however, it is advisable to engage an external investigator. Many companies naturally turn to their regular outside counsel to investigate employee complaints, but regular outside counsel may be the first choice to defend the company in the event of future litigation. A truly independent investigator may be the best way to discover the truth, provide the company with an opportunity to remedy the situation (if necessary), and keep regular outside counsel free from any conflict to later defend the company in court.
Alan DeGraw is an experienced investigator of all types of employee complaints. As in-house counsel Alan developed and implemented company investigation guidelines, trained labor relations personnel on investigating employee complaints, and counseled company investigators and employee relations personnel regarding the sufficiency of investigations. Alan has also advised companies regarding the legal risk of taking employment actions based on investigation results.
The next time your company is best served by an independent investigator, consider DeGraw & DeGraw, P.C.
